1. Operator
Agilox.com is operated by Hyperlium UG (haftungsbeschränkt), Erkrather Str 401, 40231 Düsseldorf, Germany, registered at Amtsgericht Düsseldorf, HRB 88428 (hereinafter "we", "us", or "Hyperlium").
2. Nature of the Service
Agilox.com provides an independent buyer-side preparation platform for warehouse automation projects. Users enter information about their warehouse situation, operating processes, systems, challenges, and project objectives. The platform structures these inputs into preparation observations, automation areas worth evaluating, supplier questions, indicative business-case assumptions, and planning documents.
The service is a self-service preparation and information tool. It does not constitute engineering, procurement, legal, tax, financial, investment, or other professional advice.
Platform outputs are based on user-provided data, configured assessment logic, and selected reference assumptions. They must be validated against actual operational data, site conditions, supplier evidence, technical analysis, and internal requirements before supporting any project or investment decision.
3. Your Account and Workspace
When you create a workspace, you are responsible for providing accurate information. Your workspace is protected by your email address and a time-limited magic link. You should not forward magic-link emails to others unless you intend to grant them access to your workspace data.
When you use the document-sharing feature, you are responsible for selecting the correct recipients. Agilox.com sends the document to the email addresses you enter and does not validate or screen recipients.
You may delete your account and all associated data at any time by contacting us at [email protected].
4. Acceptable Use
You agree not to:
- Use the platform for any unlawful purpose or in violation of applicable regulations.
- Attempt to reverse-engineer, scrape, or extract data from the platform in bulk without our written consent.
- Provide deliberately false or misleading assessment data with the intent to manipulate results.
- Resell, sublicense, or commercially exploit platform-generated content without attribution.
- Interfere with the security, integrity, or availability of the platform or its infrastructure.
5. Intellectual Property
All platform content, including assessment methodology, scoring logic, editorial articles, scenario analyses, and user interface design, is the intellectual property of Hyperlium. You may share or reference content for non-commercial informational purposes with attribution. Systematic reproduction or commercial reuse requires our prior written consent.
You retain rights in data you submit. Assessment outputs and planning documents generated from your input data are yours to use for internal business purposes and your own supplier discussions.
6. Disclaimer of Warranties
The platform is provided "as is" without warranties of any kind, express or implied. We do not warrant that:
- Preparation observations, planning ranges, or outputs are accurate, complete, or suitable for any specific purpose.
- The platform will be available without interruption or error.
- Platform content reflects current market, regulatory, or technical conditions at the time of use.
All outputs are indicative preparation aids. They do not constitute certified evaluations, approved business cases, or investment recommendations.
7. Limitation of Liability
To the maximum extent permitted under German law, Hyperlium is not liable for any indirect, incidental, consequential, or special damages arising from your use of the platform or reliance on its outputs, including but not limited to lost profits, business losses, or the cost of procuring substitute services.
Our liability for direct damages is limited to the amount paid by you to Agilox.com in the twelve months preceding the claim. The platform is currently free of charge; accordingly our direct liability is limited to EUR 100.
Nothing in these terms limits liability for gross negligence, wilful misconduct, or claims that cannot be excluded under applicable law, including claims arising from personal injury or mandatory statutory rights.
8. Third-Party Links
The platform includes links to external websites. We do not endorse, control, or accept responsibility for the content, products, or services of any third-party website. The presence of a link does not constitute a recommendation, partnership, or commercial relationship.
9. Trademark Notice
Agilox.com is operated independently by Hyperlium and is not affiliated with, sponsored by, or endorsed by AGILOX Services GmbH or any other automation vendor. All third-party trademarks referenced on this platform remain the property of their respective owners and are used only for informational and descriptive purposes.
10. Governing Law and Jurisdiction
These terms are governed by the laws of the Federal Republic of Germany, excluding conflict-of-law provisions. The exclusive place of jurisdiction for all disputes arising from or in connection with these terms is Düsseldorf, Germany, to the extent permitted by applicable law.
If you are a consumer resident in the EU, you may also have rights under the mandatory consumer protection laws of your country of residence, which these terms do not override.
11. Changes to These Terms
We may update these terms to reflect changes in the platform, applicable law, or our operations. We will notify registered users by email at least 14 days before material changes take effect. We recommend that you review the terms when notified of a change before continuing to use the platform.
